1. Acceptance of Terms

By accessing or using the Manetty mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Manetty is a motorsport tracking application that allows users to record driving sessions, track telemetry data, analyze performance, participate in leaderboards, and connect with other motorsport enthusiasts. The App may offer free and paid subscription plans with varying features.

3. User Accounts

To use certain features of the App, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account.

4. Acceptable Use

You agree not to: (a) use the App for any unlawful purpose; (b) upload content that infringes intellectual property rights; (c) harass, abuse, or harm other users; (d) attempt to gain unauthorized access to the App or its systems; (e) use the App while driving or in any manner that could be dangerous; (f) manipulate leaderboards or cheat in challenges.

5. User Content

You retain ownership of content you create or upload to the App (e.g., session data, profile information). By uploading content, you grant Manetty a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content within the App and for promotional purposes. You are solely responsible for your content.

6. Subscriptions and Payments

Some features require a paid subscription. Subscription fees are billed in advance on a recurring basis (monthly or yearly). You can cancel your subscription at any time through the App Store or Google Play. Refunds are subject to the policies of the respective app stores.

7. Intellectual Property

The App, including its design, features, and content (excluding user content), is owned by Manetty and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the App without our prior written consent.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. GPS AND TELEMETRY DATA MAY NOT BE 100% ACCURATE. USE THE APP AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MANETTY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PAST TWELVE MONTHS.

10. Safety Warning

Do not use the App while operating a vehicle. Always obey traffic laws and track regulations. Motorsport activities are inherently dangerous. Manetty is not responsible for any injuries, accidents, or damages that occur during your driving activities.

11. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes through the App or by email. Your continued use of the App after modifications constitutes acceptance of the updated Terms.

12. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will survive.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which Manetty operates, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.
